CONDITIONS OF SERVICE

SUPER HOST VV APARTMENTS S.L allows short-term landlords (hereinafter referred to as the client, landlord, or host) to outsource the obligations arising from the tenancy by facilitating the performance of a number of activities, such as landlord-tenant communication, check-in/check-out, cleaning and laundry, among others, thus increasing the convenience of the tenancy for landlords and guests alike.

These Terms and Conditions govern your access to and use of the website (hereinafter the Website), the services offered and the contracting of the same by customers, as well as all collective content, and also constitute a binding contract between you and SUPER HOST VV APARTMENTS S.L. Please read these Terms and Conditions carefully each time you access the Website.

We also recommend that you carefully read our Privacy Policy, as well as the Legal Notice, available on this website. If you do not agree with any of our policies, you will not be entitled to obtain information or to continue using the website or the Services.

You accept and agree that, SUPER HOST VV APARTMENTS S.L is not a PARTY to any agreement entered into between short-term landlords and guests, nor is it a real estate agency, agent or insurer. SUPER HOST VV APARTMENTS S.L has no control over the conduct of landlords, guests and/or other users of the website, the services offered by third parties or the condition of the accommodation, and disclaims all liability in this respect, to the fullest extent permitted by law.

ACCOUNT REGISTRATION

To access certain features of the Website, and to book the Services, you need to register to create an account with SUPER HOST VV APARTMENTS S.L. You can register to receive the Services directly through the Website.

Your account SUPER HOST VV APARTMENTS S.L will be created for your use of the Site based on the personal information you provide to us.

The information provided by you at the time of registration is important and must be true, complete and correct. You agree and undertake to update such information to keep it accurate, current and complete. By registering on our Website you agree to be bound by these Terms and Conditions and you agree that you have read and agree to the Terms and Conditions on our website. Upon registration you will be provided with a strictly personal username and password which you agree to keep confidential.

You are responsible for safeguarding your password. You will immediately notify SUPER HOST VV APARTMENTS S.L any unauthorised use of your SUPER HOST VV APARTMENTS S.L You may not assign or otherwise transfer your account to any other person or entity. SUPER HOST VV APARTMENTS S.L to another party. You will be responsible for any and all activities conducted through your account on SUPER HOST VV APARTMENTS S.L.

By registering on our website you declare that you are of legal age, with full capacity to act and that you are able to contract the services offered, SUPER HOST VV APARTMENTS S.L 

The cancellation of your registration on the website of SUPER HOST VV APARTMENTS S.L for any reason whatsoever shall automatically terminate this Agreement.

OBJECT OF THE CONTRACT

The subject matter of the contract is established as the provision of management services in relation to the short-term letting of dwellings, by SUPER HOST VV APARTMENTS S.L in favour of the lessor, who would be our main customer.

TARIFF

The FULL management mode will include all the services offered by SUPER HOST VV APARTMENTS S.Lwhich are detailed below in the Services section.

The tariff of SUPER HOST VV APARTMENTS S.L will be 18% (VAT included) on the total amount of the rental reservation. The total amount of the rental booking is the result of multiplying the price per night by the number of nights paid by the guest. 

The cleaning costs are to be borne by the guests and are to be paid by the owner to SUPER HOST VV APARTMENTS S.L together with the 18% tariff.

The registered customer will be able to review and modify through his customer space within the website, certain information related to his accommodation, such as a calendar of selected and available dates or visitor and revenue information among others.

SERVICES

The services defined below shall be included in the management contract in Full by short-term landlords.

Check-In

SUPER HOST VV APARTMENTS S.L check in guests through one of the means provided for this purpose, such as face-to-face check-in, opening by electronic lock (if the property has this device) or collection from the left-luggage office, among others. 

The means selected in each case for the check-in will be subject to the choice of SUPER HOST VV APARTMENTS S.L.

The following conditions shall apply to the execution of check-ins:

  • Check-ins will be carried out by default between 15:00 and 20:00 on the day of arrival of the guests. 
  • Check-ins between 13:00 and 16:00 hours are subject to availability. SUPER HOST VV APARTMENTS S.L
  • Check-ins between 20:00 and 23:00 hours are subject to availability of SUPER HOST VV APARTMENTS S.L. If it can be done, it will have an additional cost for the guest of 30€. 
  • Check-ins between 23:00 and 13:00 hours are not available. 

The check-in service must be confirmed by the guest at least 48 hours in advance. In the event that we do not have the necessary information about the guest's arrival time and means of transport, SUPER HOST VV APARTMENTS S.L does not guarantee the correct performance of the check-in service.

For the provision of the check-in service, the hirer shall deliver to SUPER HOST VV APARTMENTS S.L the required number of keys to the property, by any of the means described in the booking process.

Check-Out

After the guests' stay, SUPER HOST VV APARTMENTS S.L will proceed to collect the keys at the indicated address, verifying the state of the property. SUPER HOST VV APARTMENTS S.L recommends the landlord to remove all valuables before the arrival of the guests. SUPER HOST VV APARTMENTS S.L cannot be held responsible for items lost or damaged by guests. Guests must check out of the accommodation by 11:00 a.m. on the day of departure.

Cleaning

SUPER HOST VV APARTMENTS S.L provides cleaning services of the accommodation after the end of the guests' stay. This service includes the cleaning of bathroom/s, kitchen and bedroom/s, as well as sweeping and mopping of the entire property and removal of rubbish.

The cleaning service included in the Full management mode will be carried out by default between 11:30 and 17:00 on the day of departure of the guests. Inter-booking cleaning services during a guest's stay are not included in the price of the cleaning service and will incur an additional cost to the guest. Inter-room cleaning services are subject to availability.

The following cleaning utensils must be provided by the customer at the start of the service:

  • Mop and bucket
  • Broom and dustpan
  • Hoover
  • Staircase
  • Clothesline and clamps
  • Small basin
  • 2x scouring pad (bathroom and kitchen)
  • 2x yellow cloth (bathroom and kitchen)
  • 2x Rag
  • Cleaning gloves

The following cleaning products must be provided by the customer at the start of the service:

  • Floor cleaner
  • Grease Remover Spray
  • Bathroom cleaner
  • Window cleaner
  • Multi-surface spray
  • "Fairy
  • Liquid hand soap (one per bath)
  • Pack of rubbish bags
  • Toilet paper pack 12 rolls
  • The replenishment of cleaning products shall be carried out by SUPER HOST VV APARTMENTS S.L

In the event that such utensils and cleaning products are not found in the dwelling, SUPER HOST VV APARTMENTS S.L does not guarantee the correct performance of the cleaning service. The cleaning utensils and cleaning products that SUPER HOST VV APARTMENTS S.L The cleaning service is not included in the price of the cleaning service and will entail an additional cost for the client.

The Client authorises SUPER HOST VV APARTMENTS S.L to use the household appliances in the dwelling for the cleaning service.

The Client may request occasional cleaning services outside of a guest's booking. These cleaning services are not included in the Full Management Package and will incur an additional cost to the Client depending on the number of rooms in the property. Occasional cleaning services must be notified to SUPER HOST VV APARTMENTS S.L at least 72 hours in advance.

The customer authorises SUPER HOST VV APARTMENTS S.L to carry out a pre-cleaning prior to an incoming booking when the property has been closed and unbooked for the previous 30 days. This cleaning service is not included in the full management package and will incur an additional cost to the client depending on the number of rooms in the property:

  • APARTAMENTO AZUL Vv: 90,00€ (+ I.G.I.G)
  • APARTAMENTO AMARILLO Vv: 90,00€ (+ I.G.I.G)
  • Increasing by 25 Euros per day and person up to a maximum of 4 persons.

For the provision of the cleaning service, the lessor shall provide the following to the lessee SUPER HOST VV APARTMENTS S.L  the required number of keys to the property, by any of the means described in the booking process.

Laundry

SUPER HOST VV APARTMENTS S.L  offers a laundry and ironing service for sheets and towels. The laundry service includes the preparation and presentation of beds and bathrooms for the next booking.

The laundry service included in the Full Management Package will be provided by default between 11:30 am and 5:00 pm on the guests' day of departure. Inter-room laundry services are not included in the price of the Cleaning Service and will be at an additional cost to the guest. Inter-room laundry services are subject to availability.

In order to guarantee the laundry service, the client must leave at least 3 sets of sheets and towels sufficient for the number of guests staying. In the event that these sets of sheets and towels are not found in the property, SUPER HOST VV APARTMENTS S.L does not guarantee the correct performance of the laundry service. The property must have duvets for the number of beds.

In certain localities SUPER HOST VV APARTMENTS S.L  provides renting of sheets and towels. In these locations the Client shall not leave sets of sheets and towels at the property. The stock of sheets and towels provided by Renting is the property of . The Client undertakes to return the stock of sheets and towels at the end of the management contract.

The Client may request occasional laundry services outside of a guest's booking. These cleaning services are not included in the Full Management Package and will incur an additional cost to the Customer depending on the number of rooms in the property. Occasional laundry services must be notified to SUPER HOST VV APARTMENTS S.L  at least 72 hours in advance.

The customer authorises SUPER HOST VV APARTMENTS S.L  to use the household appliances in the dwelling for the laundry service.

Communications with guests

SUPER HOST VV APARTMENTS S.L  conduct communications with potential guests to provide information about the property and resolve issues that may arise during the booking process. SUPER HOST VV APARTMENTS S.L  will also communicate with guests before, during and after their stay to help guests enjoy a trouble-free stay.

The guest communications service included in the Full management package will be provided from 8:00 to 00:00 hours 365 days a year.

The communications service includes contact with guests to arrange check-in and check-out, explanations on how the house and appliances work, and recommendations on activities to do in the accommodation.

SUPER HOST VV APARTMENTS S.L  will assist the client with the selection and screening of guests for accommodation. The client acknowledges and accepts that he/she is solely responsible for the selection of guests according to the acceptance criteria indicated by him/her. The rental agreement for the property shall bind only the lessor and the guest. The client acknowledges and accepts that SUPER HOST VV APARTMENTS S.L  is not a real estate agent and will not negotiate or execute agreements with guests on your behalf. SUPER HOST VV APARTMENTS S.L  shall not be part of any agreement between landlords and guests.

At the end of the stay SUPER HOST VV APARTMENTS S.L  a guest report can be made on the booking portals. At the same time, guest satisfaction will be verified and guest feedback will be recorded for the optimisation of the services offered.

SUPER HOST VV APARTMENTS S.L  may mediate a possible disagreement between the landlord and the guest through the resolution centre of the rental platform where the property is advertised. SUPER HOST VV APARTMENTS S.L  reserves the right to participate in the resolution of a problem between the lessor and the guest, and assumes no responsibility for actions taken in the problem-solving process.

For the correct management and communication with the guest, it is compulsory that the property has a wireless internet connection (WIFI).

Price management and calendar

SUPER HOST VV APARTMENTS S.L  may update the price and adjust the timetable to take into account various factors (including, but not limited to, the time of year, competition or the type of building the property is built in) that may influence the rental of the property.

Profile optimisation

SUPER HOST VV APARTMENTS S.L  may assist the host with the optimisation of their accommodation profile on one of the third party platforms. The host is solely responsible for the accuracy of all information displayed in the listing.

Regarding third party platforms, SUPER HOST VV APARTMENTS S.L  shall take into account the customer's preferences, provided that the customer has communicated them in advance; in the absence of such preferences, it shall SUPER HOST VV APARTMENTS S.L  expressly reserves the right to publish such lease(s) on such platform(s) as it deems appropriate. 

Management of maintenance, repairs and replacements

SUPER HOST VV APARTMENTS S.L  is responsible for managing the maintenance tasks that may be necessary to provide the services and guarantee the guest's stay when repairs are required in the property.

The customer authorises SUPER HOST VV APARTMENTS S.L  to an autonomy of intervention whereby SUPER HOST VV APARTMENTS S.L  can manage repairs or maintenance of the property for an amount less than or equal to €150 without prior authorisation from the client. Weguest undertakes to notify the client of the details of the intervention. The cost that may be incurred for maintenance work will be borne by the Client.

In the case of repairs costing more than €150, SUPER HOST VV APARTMENTS S.L  may provide the customer with the necessary professionals for the purpose of preparing a quotation. In the event that a quotation is accepted directly by the customer, SUPER HOST VV APARTMENTS S.L  may arrange for such a professional, such as a plumber, appliance technician, locksmith or electrician. Any costs incurred for maintenance work shall be borne by the Customer. SUPER HOST VV APARTMENTS S.L  does not screen or censor professionals, nor does it have control over the accuracy, reliability, ability, completeness or timeliness of the profiles of the professionals in question and makes no representations about them. The customer expressly acknowledges that it is the customer's sole responsibility to negotiate with the professional the terms relating to the performance of any maintenance and/or repair services. SUPER HOST VV APARTMENTS S.L  assumes no liability in connection with any contract or other agreement entered into between the client and the professional.

SUPER HOST VV APARTMENTS S.L  shall not be liable for any failure or damage caused by the repair, nor shall it be liable for any warranty as to the quality or nature of the maintenance services or any other warranty associated with this work. SUPER HOST VV APARTMENTS S.L  disclaims and declines all responsibility for the quality or adequacy of any work performed, or not performed, by a professional. Accordingly, SUPER HOST VV APARTMENTS S.L  is not liable to the client or to the professional in any conflict situation, act or omission resulting therefrom, including any damages suffered, including but not limited to direct, indirect, consequential, incidental, loss of profits, and those arising out of, caused by and/or resulting from such maintenance. The customer accepts all risks associated with dealing with strangers or persons acting under false pretences.

The customer authorises S to carry out seasonal inspections of the property to ensure the proper functioning and condition of the property. These inspections will be a maximum of 2 per year. This service is not included in the Full management package and will incur an additional cost of €19.90 (VAT included) per service for the client. 

ELECTRONIC LOCK

In order to improve the quality and control of the reservation and the services associated with it, the Client expressly authorises that SUPER HOST VV APARTMENTS S.L  purchases and installs an electronic lock free of charge to the Customer, and without consideration, on the Property(ies) owned by the Customer. For clarification purposes, the ownership of the electronic lock is and shall remain with the Customer. SUPER HOST VV APARTMENTS S.L .

For these purposes, the Customer expressly authorises SUPER HOST VV APARTMENTS S.L  to install the electronic lock from this moment onwards, authorising its access to the described property/s and authorising him/her to take any necessary action to ensure that the lock is installed correctly. 

For the correct functioning of the device, it will provide the property with a broadband internet line and a stable and permanent 220AC socket, with the economic cost of this line and electricity being at the Customer's expense.

Excluded from this service are all actions required as a result of: (i) extension, improvement or modification of the electronic lock; (ii) technical assistance that is not due to defects or malfunctions of the electronic lock; (iii) technical assistance of those components of the electronic lock that have not been supplied by the electronic lock; (iv) technical assistance of those components of the electronic lock that have not been supplied by the electronic lock; (v) technical assistance of those components of the electronic lock that have not been supplied by the electronic lock; (vi) technical assistance of those components of the electronic lock that have not been supplied by the electronic lock. SUPER HOST VV APARTMENTS S.L(iv) manipulation or improper use by the Customer of the electronic lock that implies the existence of fraud or negligence in such action; (v) circumstances resulting from prior breach by the Customer of his obligations; (vi) breakdowns and/or changes in the service by the fixed or mobile telephone company and/or the electricity company owning the network, as well as those caused by surges, lightning and other cases of force majeure or fortuitous events.

The work and journeys of the technical service contracted by you SUPER HOST VV APARTMENTS S.L  that have their cause in any of the above cases, will be invoiced to the Client. Breakdown" shall be understood to mean damage that prevents the Lock from functioning properly to fulfil the purpose for which it is intended.

Technical problem' shall mean an occurrence which requires intervention by SUPER HOST VV APARTMENTS S.L  to check, whether or not in person, and which in no case prevents the electronic lock from fully functioning.

Upon termination of this Agreement, the Customer expressly consents and agrees that the electronic lock may be removed from the Property(ies) described. To this effect SUPER HOST VV APARTMENTS S.L  shall notify by any written means evidencing such notification, the time at which such de-installation will take place. In the event that the Customer does not allow the recovery of the installed lock by SUPER HOST VV APARTMENTS S.L a penalty shall accrue in favour of SUPER HOST VV APARTMENTS S.L  500 plus VAT.

OBLIGATIONS AND RESPONSIBILITIES OF THE HOST

In addition to other warranties set out in these Terms and Conditions, the host warrants that the following clauses will be complied with:

  • The host is a legal owner, lessor or authorised sub-lessor and has full authority to engage the services of the host. SUPER HOST VV APARTMENTS S.L  in relation to the terms of this Agreement.
  • The host acknowledges and accepts that SUPER HOST VV APARTMENTS S.L  may provide the proposed services through one or more third party providers. This Agreement is subject to the limitations of liability set forth herein.
  • The host acknowledges and agrees to be responsible for all property rental advertisements. SUPER HOST VV APARTMENTS S.L  assumes no liability for any breach of contract between a third party and the host.
  • The host guarantees that the information provided in its advertisements on rental platforms will be true and accurate in all respects. Under no circumstances SUPER HOST VV APARTMENTS S.L  shall have no liability whatsoever for any inaccuracy, error or omission in the advertisement of the rental property.
  • In the event that a guest stays in the rented property beyond the period agreed between the guest and the landlord, SUPER HOST VV APARTMENTS S.L  shall be completely exempt from liability, with respect to the eviction of guests and/or expenses, losses or damages associated with the guest's stay beyond the contracted period.
  • The host acknowledges and agrees that, in the event that the competent authorities of the place where the accommodation is located require the payment of any fees or taxes, or collection of any information from the guest, it shall be the host's responsibility to pay them.
  • The host acknowledges that he/she is solely responsible for the maintenance of the accommodation, and does not hold the host responsible for the maintenance of the accommodation. SUPER HOST VV APARTMENTS S.L  about any maintenance work to be carried out on the property. SUPER HOST VV APARTMENTS S.L  shall be under no obligation to notify the host of the status of the accommodation. The host may request that SUPER HOST VV APARTMENTS S.L  to arrange for any maintenance work to be carried out, which shall be charged additionally and borne by him.
  • The management and performance costs arising from maintenance work shall be borne additionally by the Customer.
  • Some jurisdictions have laws that prohibit, restrict, or regulate the rental of tourist accommodation. In this regard, the host is responsible for any administrative or civil penalties that may result from non-compliance. From SUPER HOST VV APARTMENTS S.L  the host is urged to review applicable local, regional and state regulations and consult with a lawyer before placing an advertisement on a rental housing platform. SUPER HOST VV APARTMENTS S.L  is under no obligation to inform the user about the legislation regulating holiday rentals, and is exempt from any liability in this regard.
  • It is the client's obligation to notify any type of dissatisfaction in relation to the correct performance of the services offered by SUPER HOST VV APARTMENTS S.L . If the performance of the service is ultimately found to be defective, it will be performed again at no charge to the host.
  • The Customer shall not tamper with the electronic lock and shall prevent tampering with the electronic lock by persons other than the Customer. SUPER HOST VV APARTMENTS S.L .
  • The Client shall allow SUPER HOST VV APARTMENTS S.L  access to the installation site of the Lock for any servicing or maintenance and, in particular, if any incident occurs, in which case, a person responsible for SUPER HOST VV APARTMENTS S.L  can take pictures of how the installation has turned out.
  • The Customer may not make any alterations, expansions, relocations or modifications to the original project with regard to the location of the electronic lock.

PAYMENTS AND METHOD OF PAYMENT

Hosts shall pay the charge for the services performed by SUPER HOST VV APARTMENTS S.L  through the payment method provided, once all services associated with a booking have been completed.

The host undertakes to provide and maintain a method of payment with sufficient funds to effect charges for services performed by the host. SUPER HOST VV APARTMENTS S.L  for as long as the Contract remains in force and until payment for the last service performed. The host authorises SUPER HOST VV APARTMENTS S.L  to make recurring charges for services rendered through the payment method selected in the booking process.

In the event of non-payment by the Customer, SUPER HOST VV APARTMENTS S.L  may, without prejudice to the exercise of such legal actions as it deems appropriate, request the inclusion of the Customer's data in solvency and credit files. In addition, SUPER HOST VV APARTMENTS S.L  may immediately cease to provide service to the Customer.

SUPER HOST VV APARTMENTS S.L  may, at its sole option, round up or down the amounts payable by the Hosts to the nearest functional whole number in which the relevant currency is expressed.

Where applicable, or at the request of a Client, SUPER HOST VV APARTMENTS S.L  may issue a valid invoice to such Customer.

CANCELLATIONS AND CHANGES

The customer is solely responsible for communicating to SUPER HOST VV APARTMENTS S.L  any cancellation and/or modification that may take place, assuming any penalties that may derive from the same, exonerating SUPER HOST VV APARTMENTS S.L  from any liability.

In case of termination of the management contract by the lessor/customer, SUPER HOST VV APARTMENTS S.L  shall be entitled to receive the agreed rate from the total of each booking, which has been generated by SUPER HOST VV APARTMENTS S.L  until the time of actual termination, i.e. between the date of registration as a customer of SUPER HOST VV APARTMENTS S.L  and the date of deregistration as a customer of SUPER HOST VV APARTMENTS S.L regardless of whether the services associated with such bookings occur after the termination of the agreement between the parties, even if SUPER HOST VV APARTMENTS S.L  had the management of the aforementioned reservations not been continued after the termination. To terminate the contract, it will be necessary to send an e-mail to the address "...".info@fuerteventura.site"stating the name and ownership of the landlord/client and the date of termination of the contract. The return shipment of the keys and other belongings of the Client shall be at the Client's expense. 

SUPER HOST VV APARTMENTS S.L will maintain the cancellation policy that the host has selected for its advertisement on the booking platforms, provided that the cancellation refund is made at least 48 hours prior to the guest's day of arrival. 

If no cancellation policy is selected, SUPER HOST VV APARTMENTS S.L will by default establish a full refund cancellation policy for the guest (with the exception of platform fees) at least 48 hours prior to the guest's day of arrival.
SUPER HOST VV APARTMENTS S.L shall not be liable for any financial or other repercussions that may result from cancellation of the rental by the host or the guest.

The customer who cancels the holiday rental booking(s) at their own risk and expense shall be responsible for cancelling the same on the platform in question, exonerating from any action, management and/or cost to SUPER HOST VV APARTMENTS S.Land should proceed accordingly.

EXEMPTION FROM LIABILITY

Notwithstanding the exemptions described elsewhere in these terms and conditions, the host is solely responsible for all of its communications and interactions with potential guests within a property booking portal. SUPER HOST VV APARTMENTS S.L rejects any liability in this respect.

SUPER HOST VV APARTMENTS S.L is not responsible for any damage or theft inside the property by the guest or other persons, being the electronic lock installed a purely preventive or deterrent element. The host will be solely responsible for establishing a deposit according to the characteristics of the property on the rental platform.

The Client acknowledges that the subscription of the present Contract implies the use of a series of electronic security means for preventive and dissuasive purposes that in no way guarantees the non-commission of illicit acts or replaces insurance coverage. Likewise, the Client acknowledges having received all the information necessary for the proper use of the services provided.

SUPER HOST VV APARTMENTS S.L is not responsible for the possible relocation of guests, when this takes place for reasons beyond its control. SUPER HOST VV APARTMENTS S.L. In the event that relocation should be necessary due to a failure of SUPER HOST VV APARTMENTS S.LThe company will contact the guest as soon as possible, offering the guest a suitable alternative, acting with due diligence.

SUPER HOST VV APARTMENTS S.L does not guarantee the legality, quality or existence of the advertisements published by the User nor the veracity of the same. SUPER HOST VV APARTMENTS S.L assumes no responsibility for the identity of the User.

SUPER HOST VV APARTMENTS S.L assumes no liability whatsoever, and shall not be liable for any damages (including, but not limited to, incidental, consequential or loss of profit) arising from, but not limited to, these terms and conditions and possible conflicts that may arise between these terms and conditions and those that the User has established with the guest(s), the interruption of service or failure of the Website, any communications that the User maintains with third parties, arising from cleaning and laundry services or arising from maintenance or repairs.

COMPUTER PROCESSING OF PERSONAL DATA
